- 2.3 Practice Management within 3 months of the date of this decision and provides confirmation of the completion of the respective courses (in the form of a certificate or letter of attendance from the course provider) when next applying for a practising certificate.
Reasons/basis
The Adjudicator had regard to Regulation 6.1 (a) and (d) of the SRA Practising Regulations 2009.
In particular, the Adjudicator considered that Mr Boemer is unsuitable to undertake certain activities in relation to a legal practice, namely the training and supervision of any trainee solicitor, whilst there are outstanding and unresolved concerns relating to his professional conduct that have yet to be determined at the Solicitors Disciplinary Tribunal. Accordingly, imposing the conditions at paragraph 1 will, in the public interest, limit, restrict, halt or prevent his involvement in those activities, pursuant to Regulation 6 (1)(a) of the SRA Practising Regulations 2009.
The Adjudicator was further satisfied that, pursuant to Regulation 6 (1)(d) of the SRA Practising Regulations 2009, it is in the interests of the public that Mr Boemer is required to attend the training specified at paragraph 2 above, to ensure that he is able to carry on more efficient practice.
