- 1.1 he is not a sole practitioner or sole director of recognised body;
- 1.2 he is not a manager or owner of a recognised body where all the other managers or owners
- 1.2.1 have less than 3 years experience practising as a lawyer in a firm regulated by the Solicitors Regulation Authority unless the arrangements have first been approved by the Solicitors Regulation Authority.
- 1.2.2 are recognised bodies of which he is a sole director.
- 1.3 Mr Aftab shall immediately inform any actual or prospective employer, co-manager, or co-owner of these conditions and the reasons for their imposition.

Decision details
Without prejudice to any outstanding matters and/or issues:
1. To exercise the powers conferred by Section 16(4) of the Solicitors Act 1974 (as amended), and Regulations 6 and 7 of the SRA Practising Regulations 2011, and to order that the automatic suspension of Mr Mohammed Aftab's practising certificate is terminated subject to conditions that:
- (i) he may act as a solicitor only in employment which has first been approved by the Solicitors Regulation Authority;
- (ii) he is not a sole practitioner or manager or owner of a recognised body;
- (iii) he shall immediately inform any actual or prospective employer of these conditions and the reasons for their imposition;
- (iv) he is not a signatory to any client or office bank account;
- (v) he does not hold, receive or have responsibility for client monies;
- (vi) In this condition "manager" is as defined in section 207 of the Legal Services Act 2007 and "owner" is as defined in rule 24 of the Solicitors' Code of Conduct.
Reasons/basis
Mr Aftab was adjudicated bankrupt on 28 September 2011. He made an application under Regulation 6 of the SRA Practising Regulations 2011 for reinstatement of his practising certificate which was suspended automatically on the making of the bankruptcy order. I am satisfied that it is appropriate to make an order terminating the suspension of his practising certificate subject to conditions pursuant to Regulation 7 of those Regulations. I am satisfied that the conditions imposed are necessary in the public interest and are reasonable and proportionate.
The SRA publishes regulatory decisions when it is in the public interest. I am satisfied, in accordance with the SRA's publication policy criteria, in order to maintain public confidence in the regulatory system and to demonstrate transparency in the SRA's decision making processes that this decision should be published. I am also satisfied that none of the factors that would make publication inappropriate apply.
