The Committee was satisfied that grounds for intervention existed under Paragraphs 1(1)(a), (c) and (m) of Part I of Schedule 1 Solicitors Act 1974, namely that there was reason to suspect dishonesty on the part of Mr Khan in connection with his practice as a solicitor; that Mr Khan had failed to comply with the Solicitors' Accounts Rules 1998 and the Solicitors Code of Conduct 2007; and that it was necessary to exercise the intervention powers to protect the interests of clients (or former or potential clients) of Mr Khan or his firm, or the beneficiaries of any trust which Mr Khan is or was a trustee. In addition, the Committee was satisfied that grounds for intervention existed under Paragraphs 5(3)(c) and (j) of Schedule 14 of the Courts and Legal Services Act 1990, namely that Mr Wathra had failed to comply with the Solicitors Accounts Rules' 1998 and the Solicitors Code of Conduct 2007; and that it was necessary to exercise the intervention powers to protect the interests of clients (or former or potential clients) of Mr Wathra or his firm, or the beneficiaries of any trust which Mr Wathra is or was a trustee.

Reasons/basis

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include :-

  • (i) He permitted monies to be withdrawn and/or transferred from client account other than as permitted by Rule 22 (1) (a) of the Solicitors Accounts Rules 1998 (SAR).
  • (ii) He failed to act with integrity and in the best interests of his clients.
  • (iii) He failed to keep his firm’s accounting records properly written up.
  • (iv) He failed to remedy breaches of the SAR promptly upon discovery.
  • (v) Contrary to Rule 6 of the SAR he failed to ensure the firm's compliance with the SAR.

The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.
