To secure the independent regulation envisaged by the
Legal Services Act 2007, there must be adequate separation between an approved regulator's representative functions and its regulatory functions.
The Act places a duty on the Legal Services Board (LSB) to make rules to ensure adequate separation, and the LSB will soon launch a consultation on these rules.
In advance of the consultation, we have set out our thinking about separation—in the form of a governance model and principles. We have shared our thoughts with the LSB as a contribution to the debate.
