Personal injury survey

We have started a review to better understand the personal injury legal market and the experiences of solicitors providing legal advice.

The personal injury market has undergone significant change as a result of legislative and regulatory reform and, in recent months, key stakeholder groups, including solicitors’ insurers, industry specialists and representative bodies have approached us with a number of concerns that could pose increased risk to the experiences and outcomes for consumers.

As the regulator, it is important that we gain a thorough understanding of how the market is functioning, the perceptions and experiences of solicitors practicing in this area, and views as to the prevalence and impact of concerns raised by stakeholders. We will begin this project by contacting a number of solicitors involved in personal injury work and asking them to complete a short online survey.

This provides them with an opportunity to provide their views on a number of topics including knowledge and skills of solicitors, solicitor practices and behaviours, funding arrangements, the role of fixed fees and the challenges and barriers associated with progressing claims.

The survey will take no longer than 20 minutes, all responses will be anonymised and findings will only be reported at the aggregate level. Following completion of the online survey we will be contacting selected individuals to participate in follow-up interviews.
