Solicitors, attorneys and wills

We have worked together with the Legal Ombudsman, Law Society and the Society of Trust and Estate Practitioners to produce guidance on the issue of whether or not a solicitor can give an attorney a copy of a donor's will.
The guidance says that unless the donor has expressly said the will should not be disclosed or the solicitor has reason to believe that the attorney has not, is not or will not be acting in the donor's best interests, then the will forms the property belonging to the donor and so a copy can be released.
The guidance includes standard letters to be used by the solicitor holding the will.
