Referrals – a hot potato?
SRA Update Issue 7 – January 2009
Following a review of referral arrangements, the SRA Board has decided not to impose a ban on referral payments but has agreed the following other measures:
- To ask the Rules and Ethics Committee to review what, if any, changes need to be made to rule 9, including consideration of the relationship between rule 9 and rule 1
- to refer to Rules and Ethics Committee the continued prohibition on arrangements with introducers that charge contingency fees for them to consider in the light of the Civil Justice Council review
- To authorise the development of a further compliance, enforcement and communications strategy in consultation with the Compliance Committee
- To use the firm-based recognition process to seek information and compliance declarations on referral arrangements
- To write to the Legal Services Board to support a review of referral arrangements across the legal services sector as proposed by the Law Society
