Reasons/basis

This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that, while in practice as a solicitor and partner at Capsticks LLP and in the course of conducting housing proceedings on behalf of a client:-

1. Between approximately November 2019 and May 2021 he did not take appropriate action and/or notify the client in relation to:
   1. His failure to serve Points of Dispute in time; and/or
   2. A Default Costs Certificate being issued against it.
2. From approximately April 2021 he failed to:
   1. Take appropriate action or keep the client appropriately updated in relation to steps being taken to seek recovery of costs and interest against it; and/or
   2. Provide complete and accurate information to the client in relation to its liability to pay costs and interest.

The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.
