Reliance Solicitors Limited (SRA number 626427) (the Firm) have been granted permission under Section 41 of the Solicitors Act 1974 to employ Rajesh Shah as a “Caseworker” subject to the following conditions:
- Mr Shah’s work will be directly supervised by Mr Shafaqat Ali (SRA number 441392). In the event Mr Ali is absent, Mr Shah will be supervised by Mr Muhammad Sohrab Khan (SRA number 490400).
- Mr Shah’s employment is limited to that described in the Section 41 Approval of Employment application form, dated 8 February 2022 and emails received from Mr Ali, dated 18 January 2022, 8 February 2022 and 28 February 2022.
- Mr Shah’s supervision is as per that described in the Section 41 Approval of Employment application form, dated 8 February 2022 and emails received from Mr Ali, dated 18 January 2022, 8 February 2022 and 28 February 2022.
- Mr Shah does not hold, receive or have access to client money, or act as a signatory to any client or office account, or have the power to authorise electronic transfers from any client or office account.
- Mr Shah will not deal with any conveyancing transactions or transactions involving mortgages.
- Mr Shah only meets clients in the presence of either Mr Ali or Mr Khan.
- Clients should be made aware that Mr Shah is not a solicitor.
- Mr Shah will not be responsible for supervising any other member of staff
- Any proposed variation to Mr Shah’s job description, duties, or arrangements as to his supervision are notified to the SRA in advance of the change taking place and that the variation must not take place until permission is granted by the SRA.
- This approval will lapse if Mr Shah’s employment with the Firm is terminated.
- This approval and the conditions attached to it are subject to review at the absolute discretion of the SRA.
Reasons/basis
Mr Shah was struck of the roll of solicitors on 18 December 2014. In accordance with Section 41 of the Solicitors Act 1974, any solicitor wishing to employ or remunerate him in connection with their practise as a solicitor must obtain the SRA’s approval.
The SRA is satisfied that the above employment will not put public confidence in the administration of justice and the provision of legal services or the interests of clients at risk.
