Reasons/basis
Outcome of SDT Hearing
This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which reaches its own decision after considering all the evidence, including any evidence put forward by the Respondent. The Tribunal had certified that there was a case to answer.
The matter was heard on 2-3 April 2019.
Mr. Siaw was fined £10,000.
The SDT judgment will be available at www.solicitorstribunal.org.uk
The SRA appealed on 4 grounds including that the Tribunal had made errors of law and made findings that were contrary to the weight of evidence and were not those that a reasonable tribunal could have reached.
The Appeal was heard on 8 October 2019 and Judgment handed down on 18 October 2019. The Appeal was allowed in respect of all 4 grounds.
It was ordered that:-
The sanction imposed by the Solicitors Disciplinary Tribunal (i.e. the fine of £10,000, but not the Tribunal’s order in respect of costs) be quashed and any sums paid by the Respondent in respect of the fine shall be repaid;
The Respondent shall be Struck Off the Roll of Solicitors with immediate effect.
On 6 May 2020 the Court of Appeal Civil Division refused Mr Siaw’s application for permission to appeal the judgment of the Divisional Court dated 18 October 2019.
