Cartmell Shepherd Limited has been granted permission under Section 43 of the Solicitors Act 1974 to employ Ms Claire Turnbull as a Residential Conveyancer and Private Client Clerk, subject to the following conditions:
- Claire Turnbull’s work will be directly supervised by Claire Wilson, and in her absence Debbie Flynn.
- Claire Turnbull’s employment is limited to that described in the following documents:
- Section 43 Approval of Employment form signed by Claire Wilson, dated 12 September 2021.
- Job Description attached to the Section 43 Approval of Employment form.
- Email from Mr Peter Stafford dated 13 October 2021.
- Claire Turnbull’s supervision is as per the details provided to us in the Section 43 Approval of Employment form signed by Claire Wilson on 12 September 2021, and the additional email received from Mr Stafford on 13 October 2021.
- Any proposed variation to the job description, duties, or arrangements as to Claire Turnbull’s supervision are notified to the SRA in advance of the changes taking place and that the variation must not take place until permission is granted by the SRA. Any proposed changes to the composition of the firm is also to be notified in advance to the SRA.
- Claire Turnbull shall not have any responsibility for or be involved in the training or supervision of any other employee at Cartmell Shepherd Limited.
- Claire Turnbull shall not have any responsibility for receiving or holding client money.
- This approval will lapse if Claire Turnbull’s employment with Cartmell Shepherd Limited is terminated
- This approval and the conditions attached to it are subject to review at the absolute discretion of the SRA.

Reasons/basis
Ms Turnbull was made subject to a Section 43 order on 11 October 2018. In accordance with Section 43 of the Solicitors Act 1974, any solicitor wishing to employ or remunerate her in connection with their practise as a solicitor must obtain the SRA’s approval. The SRA is satisfied that the above employment will not put public confidence in the administration of justice and the provision of legal services or the interests of clients at risk.

FINDING
Ms Turnbull was involved in a legal practice (as defined by section 43(1A) of the Solicitors Act 1974) but not as a solicitor and has occasioned or been a party to an act or default which involved such conduct on her part that in the opinion of the Society it would be undesirable for her to be involved in a legal practice in any of the ways described in the order below.
Reasons/basis
ORDER
To make an order pursuant to section 43 that with effect from 30 days after the date of the letter or email notifying Ms Turnbull of this decision:
- no solicitor shall employ or remunerate her in connection with his/her practice as a solicitor;
- no employee of a solicitor shall employ or remunerate her in connection with the solicitor's practice;
- no recognised body shall employ or remunerate her;
- no manager or employee of a recognised body shall employ or remunerate her in connection with the business of that body;
- no recognised body or manager or employee of such a body shall permit her to be a manager of the body; and
- no recognised body or manager or employee of such a body shall permit her to have an interest in the body
except in accordance with a Society permission.
