It was found that in October 2020 Mr Emerson in a draft client settlement agreement attempted to prevent an individual and a company from making disclosures to HMRC, an investigative and prosecutory body, and by doing so, Mr Emerson breached Principle 2 of the SRA Principles and paragraph 7.5 of the Code of Conduct for Solicitors RELs and RFLs.

SRA Principle 2 requires Mr Emerson to act in a way that upholds public trust and confidence in the solicitors' profession and in legal services provided by authorised persons.

Paragraph 7.5 of the SRA Code of Conduct for Solicitors RELs and RFLs requires Mr Emerson not to attempt to prevent anyone from providing information to the SRA or any other body exercising regulatory, supervisory, investigatory or prosecutory functions in the public interest.

Mr Emerson was given a written rebuke and was ordered to pay the SRA’s costs of £600 in investigating this matter.
