Reasons/basis
This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which reaches its own decision after considering all the evidence, including any evidence put forward by the Respondent. The Tribunal had certified that there was a case to answer.
The matter was heard on 15-16 September 2022.
The SDT ordered that the allegations be dismissed and made no order as to costs.
The SDT judgment will be available at www.solicitorstribunal.org.uk
The SDT’s findings are subject to an Appeal to the High Court (Administrative Court) by the Solicitors Regulation Authority. The Order remains in force pending the High Court's decision on the Appeal.
On 27 February 2023 the High Court allowed the SRA’s appeal in full for the case of Maya Nisa-Zaman. The appeal concerned the finding of the SDT at a hearing on 16 September 2022 to acquit Maya Nisa-Zaman of Allegation 1.
By way of consent the Court ordered that:
The SDT's decision to acquit the Respondent of Allegation 1 of SDT’s decision of 16 September 2022 was set aside and substituted with a finding that Allegation 1 and its particulars are found proved. Allegation 1 stated that Ms Nisa-Zaman:
- Failed to ensure that the Firm had in place a compliant, firm-wide anti-money laundering risk assessment between 26 June 2017 and, at the earliest 15 April 2020 as required by Regulations 18(1) and 18(4) of the Money Laundering Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 ('MLRs 2017').
As a result Maya Nisa-Zaman shall pay a fine of £800.
There is no order as to costs.
