Summary of decision
The SRA has put restrictions on where and how Ms Lister can work in an SRA regulated firm. It was found that Mis Lister had removed a paragraph from an original client letter, following a request to receive a copy of the letter and any enclosed documentation. In doing so, she misled the client. Ms Lister was found to have been dishonest.
The facts of the case
Miss Lister worked for Chattertons Legal Services Limited, a licensed body, whose registered office is at 5 South Street, Horncastle, Lincolnshire LN9 6DS. She worked there between January 2021 and May 2023. At the time the misconduct occurred she was a paralegal. Her current employment status is not known.
Whilst working in the conveyancing department, Miss Lister was involved in a matter relating to the first registration of a property for a client. She was found to have amended an original client letter in order to remove reference to enclosures, which were believed to be lost in the post. In this way, she misled the client
Our decision on outcome
An order pursuant to section 43(2) of the Solicitors Act 1974 was imposed as Miss Lister’s conduct meant that it was undesirable for her to be involved in a legal practice without the SRA’s prior approval.
This is because Miss Lister’s conduct was serious and it was found to be dishonest.
Miss Lister was ordered to pay the SRA’s costs of £600 in investigating this matter.
What our Section 43 order means
To make an order pursuant to section 43 that with effect from the date of the letter or email notifying Miss Lister of this decision:
- no solicitor shall employ or remunerate her in connection with his/her practice as a solicitor;
- no employee of a solicitor shall employ or remunerate her in connection with the solicitor's practice;
- no recognised body shall employ or remunerate her;
- no manager or employee of a recognised body shall employ or remunerate her in connection with the business of that body;
- no recognised body or manager or employee of such a body shall permit her to be a manager of the body;
- no recognised body or manager or employee of such a body shall permit her to have an interest in the body.
