Terms and conditions of the licence

The general conditions which apply to licensed bodies contained in Rule 8 of the SRA Authorisation Rules for Legal Services Bodies and Licensable Bodies as applicable.

Any obligation which may from time to time be imposed on [The Firm] or a manager, employee, or non-authorised interest-holder in [The Firm] by or under the SRA's licensing rules or by or under the LSA, or any other enactment.

[The Firm] may carry on exempt regulated activities under Part XX of the Financial Services and Markets Act 2000 provided that such activities arise out of or are complementary to the firm’s reserved legal activities or other legal activities.

Waiver(s)

The information below is a summary of the waiver(s) granted.

1. Berkeley Hurrell Limited has been granted a waiver from Rule 8.6(a)(ii) of the SRA Authorisation Rules for Legal Services Bodies and Licensable Bodies 2011 as it applies to the managers of one of the corporate owners; 

2. Berkeley Hurrell Limited has been granted a waiver from Rule 8.5(b)(i) of the SRA Authorisation Rules for Legal Services Bodies and Licensable Bodies 2011 to allow Laurence Michael Gavin, who is not a manager or employee of Berkeley Hurrell Limited, to be the designated Compliance Officer for Legal Practice (COLP) of Berkeley Hurrell Limited.

   This waiver is subject to the following conditions:

   • i. Mr Gavin must at all times remain a manager and COLP in at least one other of the Irwin Mitchell group companies;
   • ii. Mr Gavin must remain as Company Secretary of Berkeley Hurrell Limited;
   • iii. Berkeley Hurrell Limited must continue to have its day-to-day compliance work carried out by the Risk & Compliance team for the Irwin Mitchell group of companies; and
   • iv. Berkeley Hurrell Limited must continue to have Irwin Mitchell Holdings Limited as a parent undertaking.

   If any of the above conditions cease to be met, the waiver will be revoked with immediate effect.

3. Berkeley Law Limited and Berkeley Hurrell Limited have been granted a waiver from the requirements of Outcomes 12.1 and 12.2 to Chapter 12 of the SRA Code of Conduct 2011 as it applies to the connected separate business of Coris UK Limited, subject to the following conditions:

   • i. This waiver only extends to the prohibited separate business activities that are currently done by Coris UK Limited, namely conducting claims handling work on behalf of Defendant insurers including: assessment of fault and/or quantum of a claim; pre-action work; Green Card and 4th Directive representation of participating insurers; uninsured loss recovery; legal defence through third party solicitors; and claims recovery;
   • ii. Where any work is transferred from Coris UK Limited to any of the entities to which this waiver has been granted, the client of Coris UK Limited is informed, in writing, of the connection between Coris UK Limited and the entity the work is being referred to; and
   • iii. Should it be necessary for any of the entities to which this waiver is granted to transfer work back to Coris UK Limited, it is made clear to the client, in writing, the point at which Coris UK Limited takes conduct of the matter and SRA regulation ceases.
