This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal.  This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Respondent.  The Tribunal has certified that there is a case to answer in respect of allegations which are or include that Mr Waterfield:- 

Completed conveyancing transactions unsupervised meaning he gave undertakings when he was not authorised to do so and there were significant delays in registering properties. 

There was a cash shortage on the client account, month end client account reconciliations were not undertaken and an accountant’s report was not submitted. Sufficient funds were not set aside to pay VAT causing the firm to become insolvent. 

Submitted financial information to Companies House which he knew or ought to have known was incorrect and misleading. 

The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.
