It was found that Irwin Mitchell LLP failed to give proper advice to clients in 2013 before switching the funding of their case from legal aid to a conditional fee agreement. In doing so, it
- Failed to act in the best interests of clients, in breach of Principle 4 of the SRA Principles 2011.
- Failed to provide a proper standard of service to clients, in breach of Principle 5 of the SRA Principles 2011.
- Failed to achieve outcome 1.12 of the SRA Code of Conduct 2011, requiring the firm to ensure that clients are in a position to make informed decisions about the options available to them.
Irwin Mitchell LLP was directed to pay a financial penalty of £9,000 and costs of £1,350.
