Reasons/basis
This notification relates to a Decision to prosecute before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that, while acting under a lasting power of attorney and in a professional capacity, he engaged in serious misconduct, namely that he:
Misappropriated client money to pay a personal tax liability
Caused or allowed loans to be made from a client's funds to a company in which he had a personal financial interest, without the client's consent and without securing the loans
Acted on behalf of parties where there was a conflict of interest
Transferred trust funds without the agreement of a co-trustee
And
Breached the SRA Solicitors Accounts Rules by using client accounts as a banking facility.
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.
