Ms Gauberti was issued with a written rebuke and ordered to pay costs of £1350.
We have issued Ms Gauberti with a rebuke for permitting information relating to her SRA Authorisation status to be contained within Crefovi's client care documents, which was misleading.
Ms Gauberti also failed to co-operate with the SRA during an investigation into her conduct
Reasons/basis
Ms Gauberti is the Director of Crefovi, a French law practice. The business is not authorised by the SRA.
Ms Gauberti is on the Roll of solicitors with a current practicing certificate (SRA ID 446075). She is also registered with the SRA as a freelance solicitor (SRA ID 828144).
The SRA received a report from a client of Crefovi, who had instructed them to handle infringement issues with retailers in France. The report predominantly concerned service issues, and the SRA signposted the client to the Legal Ombudsman. However, the report also highlighted that the client was confused as to which entity was representing him.
In response to the SRA's queries, Ms Gauberti provided 2 client care letters, which she said clearly demonstrated the agreement was between the client and Crefovi. She stated that it is always 300% clear that the entity instructed is the law firm Crefovi.
The SRA advised Ms Gauberti that the information contained in her client care agreements was misleading and that she should not be using her SRA authorisation details on Crefovi's letterhead. The SRA asked for remedial action to be taken.
There was some discussion between Ms Gauberti and the SRA regarding the remedial action, however, Ms Gauberti has not confirmed whether she has made the necessary amendments to the letterhead. She was informed that if she failed to cooperate with the requests further investigation may be pursued.
