This notification relates to a Decision to lodge Disciplinary Proceedings before the Solicitors Disciplinary Tribunal. This is an independent Tribunal which will reach its own decision after considering all the evidence, including any evidence put forward by the Solicitor. The Tribunal has certified that there is a case to answer in respect of allegations which are or include that, while acting in a professional capacity, he engaged in serious misconduct, namely that he:
- Made false and misleading statements in support of his applications for professional indemnity insurance cover
- Failed to ensure that reconciliations were carried out in a compliant manner, or at all
- Failed to maintain accurate and compliant books of account
- Failed to ensure that client money was returned promptly once there was no longer any proper reason to retain it
- Failed to obtain and/or disclose a Qualified Accountant's Report to the SRA and failed to provide information requested by the SRA during its investigation; and
- Failed to ensure that his Firm had in place a documented Firm-wide risk assessment, as required under the Money Laundering Regulations 2017.
The allegations are subject to a Hearing before the Solicitors Disciplinary Tribunal and are as yet unproven.

The Panel was satisfied that grounds for intervention existed under Paragraph 1(1)(c) of Schedule 1 of the Solicitors Act 1974 (as amended) namely that Shashi Patel had failed to comply with the rules made under sections 31 and 32 of the Act.
