Carey York was made subject to an order pursuant to section 43(2) of the Solicitors Act 1974 (as amended). She was given a written rebuke and ordered to pay a financial penalty of £2000 and costs of £1350.
Carey York who is or was involved in a legal practice (as defined by section 43 (1A) of the Solicitors Act 1974) but is not a solicitor, has occasioned or been a party to, with or without the connivance of a solicitor, an act or default in relation to a legal practice which involved conduct on her part of such a nature that in the opinion of the Society it would be undesirable for her to be involved in a legal practice in all of the ways set out below.
Order
- no solicitor shall employ or remunerate her in connection with his/her practice as a solicitor;
- no employee of a solicitor shall employ or remunerate her in connection with the solicitor's practice;
- no recognised body shall employ or remunerate her;
- no manager or employee of a recognised body shall employ or remunerate her in connection with the business of that body;
- no recognised body or manager or employee of such a body shall permit her to be a manager of the body; and
- no recognised body or manager or employee of such a body shall permit her to have an interest in the body
except in accordance with a Society permission.
Reasons/basis
Carey York is not a solicitor and was employed as the Finance Director and Compliance Officer for Finance and Administration by Emery Johnson Solicitors in the firm's Leicester office at 3-5 Welford Road, Leicester between 5 February 2007 and 13 October 2015. During her employment with Emery Johnson Solicitors, she was found to have used the firm's credit card, to purchase items from Amazon and Welcomm for her own personal use without the firm's authority. She also e mailed Pay Academy on 8 June 2015 and instructed it to increase her pay without the firm's authority.
Carey York resigned on 13 October 2015 and is currently not involved in a legal practice.
