Decision details
To grant the application made by Patron Law Limited, under Section 41 of the Solicitors Act 1974 (as amended), to employ Mr Mohammed Kamruzzaman as a paralegal subject to the following conditions:
- Mr Kamruzzaman must not receive or handle client money or be a signatory to any office or client account;
- Mr Kamruzzaman must not have his own caseload;
- Mr Kamruzzaman must not take instructions from or provide advice to clients without the knowledge and consent of his supervisor;
- Mr Kamruzzaman‟s name must not appear on any of the firms‟ publicity material; and
- Mr Kamruzzaman‟s status as a non-solicitor must be made clear to clients.
Reasons/basis
The conditions on Mr Kamruzzaman's employment at Patron Law Ltd were imposed to mitigate the risk presented by the Tribunal's decision, on 18 June 2013, to strike him off the Roll of Solicitors. In substantiating breaches of the Solicitors Act 1974 and the Solicitors Accounts Rules 1991, the Tribunal found that he had acted dishonestly.
